GiSC’s Ag Data Use Agreement defines “Ag Data” as:
Irrigation Data. This includes information generated by irrigation equipment and field sensors to measure water usage, flow, pressure and related data. It can also include electric smart meter and engine hour meter data when used to estimate water use.
Agronomic Data. This includes crop and field information, such as planting data, seed type, yield, disease and pest management application, fertilization, and prescriptions.
Land Data. This includes soil and fertility data, topographical, elevation, watershed, and drainage data, geospatial information, and tillage and conservation data.
Farm Management Data. This includes information related to financial, tax, employment, commodity price, regulatory compliance, supply chain, and other management data.
Machine Data. This includes telematics information, machine health, fuel consumption, load, use, and other machine performance data.
Weather Data. This includes precipitation, wind speed and direction, temperature, and other weather information.

3. Ownership
Do the tech company’s agreements with the user address ownership of user data?
Yes. You are the owner of Ag Data that originates from your farm, device, or equipment. GiSC believes that ownership should give you the right to share, download, and delete your Ag Data.

4. Transparency in Aggregation
Does the tech company allow the user to opt out of inclusion in anonymized and aggregated datasets that are accessible by other users?
Yes. Section 4.2 of GiSC’s Ag Data Use Agreement states: GiSC’s default setting does not aggregate your Ag Data. You must “opt in” to participate in aggregated data sharing.

5. Vendor Access to Data
Does the tech company require outside contractors that have access to user data to follow the tech company’s data policies?
Yes. Section 4.3 of GiSC’s Ag Data Use Agreement states: To the extent the GiSC engages third parties to perform data processing on your Ag Data, these companies must abide by this Agreement at all times.

6. Consent
Does the tech company obtain a user’s consent before sharing user data with third parties? (E.g. integrations, government and others)
Yes. Section 5 of GiSC’s Ag Data Use Agreement promises that GiSC will obtain your consent prior to sharing your Ag Data with any of the follow types of third parties.

7. Consent
By signing up, does the user give the tech company the right to sell aggregated data to third parties without obtaining further consent?
Yes. Section 4.2 of GiSC’s Ag Data Use Agreement provides that if you opt in to participate in aggregated data sharing, aggregated data can be used by GiSC for any lawful purpose.

8. Portability
Does the tech company maintain an original copy of user data that can be retrieved or deleted upon a user’s request?
Yes. Section 6 of GiSC’s Ag Data Use Agreement states that, as long as you maintain an active account with GiSC you may download your original dataset. However, in some circumstances, your Ag Data may not be retrievable in its original format.

9. Data Security
Will the tech company notify the user if a breach of data security causes disclosure of the user’s data to an outside party?
Yes. In the event of a data breach, natural disaster, or other unforeseen event that causes your Ag Data to be deleted or compromised, GiSC will notify you when you log in, by email, or other method required by law.

10. Notice
Will the tech company notify the user when data agreements are changed and summarize how the agreements were changed?
Yes. GiSC will notify you by email or at your next log in when an agreement changes, according Section 7 of the Ag Data Use Agreement.

11. Changes in Company Ownership
Do the tech company’s data agreements address what happens to user data if the tech company is sold to another company?
Yes. GiSC cannot be sold without the majority consent of its members. In the event the GiSC is sold to another company (meaning at least 51% of GiSC ownership interest is transferred in a single calendar year), you will be notified and have the option of deleting your Ag Data for at least thirty (30) days after the transfer.
