Personal information, by which you may be personally identified, such as name, postal address, email address and telephone number.
About the grower, but individually does not identify them, such as anonymized and aggregated datasets
Any agricultural data as broadly understood in the agricultural industry, including, but not limited to, agronomic data, application data, climate data, harvest data, invoice data, planting data, land data, machine data, pricing data, grain sales data, weather data, and the type of agricultural products you produce or services you use and purchase from third parties.
About the grower's internet connection, the equipment they use to access our Platform, and usage details.

3. Ownership
Do the tech company’s agreements with the user address ownership of user data?
Yes.
The customer retains ownership of all data collected through their applications. Incite.ag processes farmer data with the explicit consent of the farmer, which can be revoked at any time.
Farmers retain ownership of the data they share with Incite.ag, including any GHG and Carbon Intensity (CI) scoring derived from this data. However, Incite.ag will own any aggregated, anonymized, and analyzed insights generated beyond CI scoring and avoided emissions information. By using our services, customers grant Incite.ag a non-exclusive, worldwide license to access, process, and analyze the data for the aforementioned purposes while ensuring privacy and confidentiality in line with applicable privacy laws.

4. Transparency in Aggregation
Does the tech company allow the user to opt out of inclusion in anonymized and aggregated datasets that are accessible by other users?
Yes. We may disclose aggregated information about our users, and information that does not identify any individual, with their consent. Users have the right to opt out of any inclusion in aggregated datasets by sending an email to data@incite.ag.

5. Vendor Access to Data
Does the tech company require outside contractors that have access to user data to follow the tech company’s data policies?
Yes. To contractors, service providers, and other third parties we use to support our business and who are bound by contractual obligations to keep grower information confidential and use it only for the purposes for which we disclose it to them.

Yes. Incite.ag does not provide grower information to another party without explicit consent from them.
Incite.ag may disclose grower information to contractors, service providers, and other third parties Incite Ag uses to support the business and who are bound by contractual obligations to keep your information confidential. Incite Ag may also disclose your information under special circumstances, which include:
To comply with any court order, law, or legal process, including to respond to any government or regulatory request.
To enforce or apply our terms of use and other agreements, including for billing and collection purposes.
If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Incite.ag, our customers, or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

By signing up, does the user give the tech company the right to sell aggregated data to third parties without obtaining further consent?
No. Use of the Platform does not grant Incite.ag the right to sell anonymized or aggregated data to third parties without further consent from you.

8. Portability
Does the tech company maintain an original copy of user data that can be retrieved or deleted upon a user’s request?
Yes. Incite.ag maintains an original copy of your information for the duration of your use of the Platform. You may request access to your information at any time.

9. Data Security
Will the tech company notify the user if a breach of data security causes disclosure of the user’s data to an outside party?
Yes. Incite.ag has implemented measures designed to secure grower’s personal information from accidental loss and from unauthorized access, use, alteration, and disclosure. All information growers provide to us is stored on our secure servers behind firewalls.
The safety and security of grower’s information also depends on them. Where we have given growers (or where they have chosen) a password for access to certain parts of our Platform, they are responsible for keeping this password confidential. Incite.ag asks growers not to share their password with anyone.
In the event of a breach of growers personal information by an unauthorized person, we will investigate and if necessary, provide notice to growers as required by applicable law.

10. Notice
Will the tech company notify the user when data agreements are changed and summarize how the agreements were changed?
Yes. We will post any changes we make to our Policy on the Platform home page. If we make material changes to how we treat our users’ personal information, we will notify users by email to the primary email address specified in their account and through a notice on the Platform home page that describes or summarizes those material changes. The date the Policy was last revised is identified at the top of the page. Growers are responsible for ensuring we have an up-to-date active and deliverable email address for them, and for periodically visiting our Platform and this Policy to check for any changes.

11. Changes in Company Ownership
Do the tech company’s data agreements address what happens to user data if the tech company is sold to another company?
Yes. Incite.ag may need to disclose user information to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of the Company’s assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which personal information held by the Company about our Platform users is among the assets transferred.
