1. What categories of data does the product or service collect from me?

  • Agronomic Data

  • Land Data

  • Farm Management Data

  • Machine Data

  • Weather Data

We collect all five AgGateway categories of farm data, and they are included in our definition of “Ag Data”, which we define as“any agricultural data, as broadly understood in the agricultural industry, including, but not limited to, your agronomic data, application data, climate data, harvest data, invoice data, planting data, land data, machine data, pricing data, weather data, and the type of agricultural products or services you use and purchase from us or other parties.”

2. Do the ATP’s agreements address ownership of my data after my data is transferred?

One of the core principles of Farmers Business Network is that “[t]he Ag Data, Financial Data and Personal Data you provide us is Your Data,” and that “[b]y joining our network and providing us Your Data, you grant us the right to use Your Data for purposes that will enhance the value we provide our members and as described below. This may include using anonymized data from all our members to create insightful models and provide transparent agronomic, product, and market information to the FBN Network. We own the Services and the Content, including aggregated and/or anonymized data, analytics, benchmarking, etc.

3. If the ATP contracts with other companies to provide data related services, does the ATP require these companies to adhere to the ATP’s privacy policies with me?

"Any third-party service providers which are engaged by us must agree to follow the privacy standards set by this [Privacy] Policy or similar standards that are equally protective of our members."

4. Will the ATP obtain my consent before providing other companies with access to my data?

"We neither provide nor sell your Your Data in personally identifiable form to anyone. However, we may share Your Data with third parties as described in this Policy, our Terms of Service or when you provide your consent."

5. After I upload data to the ATP, will it be possible to retrieve my original complete dataset in an original or equivalent format?

"You may request that we provide you with a copy of any Ag Data that has been uploaded to your account in the original format it was uploaded, or an equivalent format, by contacting us at info@farmersbusinessnetworkat any time during your membership and for thirty (30) days thereafter."

6. Will the ATP notify me when its agreements change?

"We’re always working to improve the Services, so these Terms may need to change along with the Services. We reserve the right to change the Terms at any time, but if we do, we will bring it to your attention by placing a notice on the website, by sending you an email, and/or by some other means. If you don’t agree with the new Terms, you are free to reject them; but that means you will no longer be able to use the Services."

7. Will the ATP notify me if a breach of data security occurs that causes disclosure of my data to an outside party?

"In the event of a breach of Your Data by an unauthorized person, we will investigate and if necessary, provide notice to you by email or upon your next log in."

8. Upon my request, can my original dataset be deleted when my contract with the ATP terminates?

"After termination, we may continue to retain and use Your Data consistent with this Policy and our Terms of Service, or we may delete Your Data after thirty (30) days, but we are under no obligation to do so. In certain cases, there may be technological or regulatory limits to our ability to delete Your Data."

9. Do the ATP’s agreements establish how long my original datasets will be retained?

10. Do the ATP’s agreements address what happens to my data if the ATP is sold to another company?

"We may choose to buy or sell assets. If we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of ownership, or a grant of a security interest in all or part of us through, for example, an asset share or share sale, or some other form of business combination, merger or joint venture, Your Data could be one of the assets transferred to or acquired by a third party. Even if that happens, this Policy (including the provisions governing changes to this Policy) will continue to apply to the use of Your Data."
