FarmLink collects Licensee Content which means any data and information distributed or submitted electronically or otherwise by you via the Software, including but not limited to, data, content user accounts and images, farm data, land data (including precise location), agronomic data (such as commodity pricing, information relating to acres, yields, production values), farm management data (such as information about sales, cashflows, inventory), and other business information.

3. Ownership

Do the tech company’s agreements with the user address ownership of user data? 

Yes. FarmLink also does not own the raw data that users provide to us via GrainFox, regardless of whether it is considered personal information or not. Section 6.1(b) of our EULA states that the user is the sole and exclusive owner of the content they submit via GrainFox. Users provide GrainFox with a licence to use that data for purposes like aggregating it and providing the customer with reports which are part of our service. FarmLink does not sell user data, in either aggregate or non-aggregate form.

4. Transparency in Aggregation

Does the tech company allow the user to opt out of inclusion in anonymized and aggregated datasets that are accessible by other users? 

No. Users cannot opt out of inclusion in anonymized and aggregated datasets, but those datasets are not directly available to other users. FarmLink uses those datasets to generate the reports and recommendations for individual users that are the primary service offered by the GrainFox app.

5. Vendor Access to Data

Does the tech company require outside contractors that have access to user data to follow the tech company’s data policies? 

Yes. When FarmLink engages a third party service provider who will have access to Licensee Content, we use contractual and other means to ensure the Licensee Content is afforded protections which are substantially similar to those provided by FarmLink to its users.

Farmlink enters into agreements with its contractors. These agreements have strong confidentiality clauses and these agreements require contractors to follow Farmlink’s data policies.

6. Consent

Does the tech company obtain a user’s consent before sharing user data with third parties? (E.g. integrations, government and others)

Yes. With respect to personal information, as per section 4(c) of the Privacy Policy, FarmLink does not disclose users’ personal information to third parties without their consent or as required or allowed by applicable laws.

With respect to non-personal information about particular farms (“Licensee Content”), users are given the opportunity to review the EULA while signing up. By agreeing to the terms of the EULA, users grant FarmLink a licence to use that data and therefore consent to FarmLink sharing that data, as per section 4.2(b).  This license includes a royalty-free, fully-paid, perpetual, irrevocable, transferable, sublicenceable, worldwide and non-exclusive right and licence to access, reproduce, copy, distribute, create derivative works of, adapt, translate, transmit, arrange, modify, host, bundle, use and fully exploit the Licensee Content and any Intellectual Property relating thereto (the “Content Licence”).

7. Consent

By signing up, does the user give the tech company the right to sell aggregated data to third parties without obtaining further consent?

Yes. FarmLink does not own the raw data that users provide to us via GrainFox – this is Licensee Content. Section 6.1(b) states that the user is the sole and exclusive owner of the Licensee Content. When users sign up, they are provided the opportunity to review the EULA. By agreeing to the terms of the EULA, users grant FarmLink the licence to use the Licensee Content for purposes like aggregation and providing the user with reports which are part of our service and are the property of FarmLink. FarmLink does not currently sell or share Licensee Content in either aggregate or non-aggregate form.

8. Portability 

Does the tech company maintain an original copy of user data that can be retrieved or deleted upon a user’s request? 

Yes. Upon request, FarmLink will provide the user with access to or a copy of the Licensee Content within a reasonable timeframe, provided that FarmLink still retains any Licensee Content and subject to any restrictions imposed by FarmLink’s Privacy Policy and/or applicable laws.

9. Data Security

Will the tech company notify the user if a breach of data security causes disclosure of the user’s data to an outside party?  

Yes. In the event that there is a breach of our security safeguards, FarmLink will comply with relevant data breach and privacy laws.

10. Notice

Will the tech company notify the user when data agreements are changed and summarize how the agreements were changed? 

Yes. Section 22 of our Privacy Policy sets out our procedure for sending out notices.

11. Changes in Company Ownership

Do the tech company’s data agreements address what happens to user data if the tech company is sold to another company?
