Farmers and entities with whom the farmer chooses to share their farm data such as Ag retailers, Ag professionals (e.g., agronomists) and Ag service providers.

As specified in our Climate Privacy Statement (“Privacy Statement”) and Climate FieldView™ Terms of Service (“Terms of Service”), we may collect your first and last name, email, address, zip code, demographic information, preferences, machine data (including make, model, and configuration settings of your farming equipment), or other information about you that you voluntarily send to us through the Climate Services (as defined in the Terms of Service) or through communications with us. When you use the Climate Services (as defined in the Privacy Statement), we also may automatically collect information directly or through our third-party analytics providers. A complete list of such information is listed in our Privacy Statement. Some FieldView™ Services (as defined in the Terms of Service) may require you or your authorized users to upload, input, transmit, store or otherwise make available to Climate information about your farm operation, such as your field locations, maps or boundaries, recorded environmental, weather or climatic conditions, agronomic practices, crop losses, crop yields, field images, field notes and other information relating to your farm operation (“Customer Farm Data”). You may not be able to use certain features of the FieldView™ Services if you do not provide this information. Please see our Privacy Statement and Terms of Service for additional details.

3. Ownership

Do the tech company’s agreements with the user address ownership of user data? 

Yes. The Terms of Service 4.1 state that, as between you and Climate, you are the owner of all Customer Farm Data you provide to FieldView™. You grant Climate a non-exclusive license to access, use, reproduce, display, modify, and prepare derivative works based on your Customer Farm Data in order to provide FieldView™ Services to you, for Climate’s internal operations, and research and development services. Climate is the owner of any works created by Climate, including Aggregated and Anonymized Information, as defined in Climate’s Terms of Service 4.2.

4. Transparency in Aggregation

Does the tech company allow the user to opt out of inclusion in anonymized and aggregated datasets that are accessible by other users? 

No. Climate FieldView™ offers a base level of functionality allowing users to collect and visualize data without uploading Customer Farm Data to our servers.  If the option to maintain data locally is chosen, it is not uploaded to Climate servers nor is it included in aggregated datasets. However, some FieldView™ Services may require you or your authorized users to upload Customer Farm Data to Climate’s systems.  You may not be able to use certain features of the FieldView™ Services if you do not provide this information.  Data that is stored within the Climate FieldView™ system may be used to generate datasets that have been aggregated or anonymized such that it is not personally identifiable to you as set forth in the Climate FieldView™ terms of service. Users who do not wish to have their information used for this purpose should not upload Customer Farm Data to FieldView™; for previously uploaded data, users may request that we close and permanently delete their account by contacting the Climate Director of Data Privacy using the form or at the address provided in our Privacy Statement.

5. Vendor Access to Data

Does the tech company require outside contractors that have access to user data to follow the tech company’s data policies? 

Yes. As specified in our Privacy Statement, we may share information about you with third parties that perform services on our behalf, such as running our Climate Services, sending communications for us, and executing marketing programs and promotions for us. We will not share information about you with any non-affiliated third-party vendor or website owner for their own marketing purposes without your consent. 

It's our practice to require third parties who perform services for Climate and have access to your personal data to follow data protection principles which are substantially similar to those in our Privacy Statement.

6. Consent

Does the tech company obtain a user’s consent before sharing user data with third parties? (E.g. integrations, government and others)

Yes. Our Terms of Service specify how and when we may share your data. We will not share information about you with any non-affiliated third-party vendor or website owner for their own marketing purposes without your consent. Climate allows you to share certain information, including Customer Farm Data and Climate Generated Works (as defined in Terms of Service), with other Climate FieldView™ users, such as your agronomist or sales representative, within the FieldView™ Services, or to share certain information with third parties who are Climate platform partners by linking your Climate FieldView™ account to an account with the platform partner. Please see our Privacy Statement and Terms of Service for additional details. We do not share your data with any third-party Platform Partners without your express consent.

7. Consent

By signing up, does the user give the tech company the right to sell aggregated data to third parties without obtaining further consent?

No. Climate does not sell user personal information or Customer Farm Data, nor do we share it with third parties without user consent as set forth in our Terms of Service and Privacy Statement.  We do, however, reserve the right to use Aggregated or Anonymized Information—that is, information that has been aggregated or anonymized such that it is not personally identifiable to a user by a person using reasonable skills—for a variety of purposes as set forth in our Terms of Service without seeking additional user consent. Please note that it is our policy not to use Customer Farm Data or Aggregated or Anonymized Information derived from Customer Farm Data to make speculative commodities trades, other than hedging we may do during the normal course of business to manage risks associated with our own seed/commodity production operations.

8. Portability 

Does the tech company maintain an original copy of user data that can be retrieved or deleted upon a user’s request? 

Yes. Upon written request, and in a reasonable period of time, Climate will provide a customer with a copy of all of the information they provided to Climate in the same format that such information was provided to Climate. Users may request that we close and permanently delete their FieldView™ Account at any time by contacting the Climate Director of Data Privacy using the form or at the address provided in our Privacy Statement Please see our Privacy Statement and Terms of Service for additional details.

9. Data Security

Will the tech company notify the user if a breach of data security causes disclosure of the user’s data to an outside party?  

Yes. We have implemented technical, administrative, and physical security measures designed to protect your personal data from unauthorized access, disclosure, use, and modification. Although we strive to keep your personal data secure, no security measures are absolute. We are committed to providing notice of any data breach as may be required by applicable law.  Use caution when transmitting personal data over the Internet.

10. Notice

Will the tech company notify the user when data agreements are changed and summarize how the agreements were changed? 

Yes. Changes to our Terms of Service and Privacy Statement are posted on Climate’s website or within the Climate Services. If there are material changes made to Climate’s Privacy Statement or Terms of Service, Climate will post a prominent notice on Climate Services, which will appear when you log into your account and provide other notice as required by law. 11. Changes in Company Ownership

Do the tech company’s data agreements address what happens to user data if the tech company is sold to another company?

Yes. If Climate is sold to another company, we will use reasonable efforts to make sure the transferee uses your information in a manner consistent with our Privacy Statement. Please see our Privacy Statement and Terms of Service for additional details.
