Carbon by Indigo collects a variety of current and historical data for purposes of quantifying and verifying the amount of greenhouse gases avoided or sequestered on enrolled acres, including field level crop selection, cover crops, tillage, fertility management with synthetic and organic amendments, irrigation, yield, and if relevant, grazing practices (for example “Data” including “Land Management Records”) . Treatment of any information you submit relating to an identified or identifiable natural person is covered in Indigo’s Privacy Policy.

3. Ownership
Do the tech company’s agreements with the user address ownership of user data?
Yes. As between you and Indigo, all data you submit to Indigo, belongs to you after transfer to Indigo. You agree that the data you submit to Indigo will be aggregated with other data in Indigo’s data base and used for the purposes described in the Indigo Carbon Agreement, including for quantifying and verifying the amount of greenhouse gas emissions avoided or sequestered on your land. Indigo may use aggregated and de-identified data for its research and development initiatives, including to promote the study or adoption of sustainable and/or environmentally beneficial agriculture practices and programs as described in the Indigo Carbon Agreement.

4. Transparency in Aggregation
Does the tech company allow the user to opt out of inclusion in anonymized and aggregated datasets that are accessible by other users?
No. Aggregation of data is necessary for the generation, verification and issuance of carbon credits.

5. Vendor Access to Data
Does the tech company require outside contractors that have access to user data to follow the tech company’s data policies?
Yes. Any third-party service provider that Indigo shares information with or discloses information to will legally be required to provide the same or equal protection of user data as provided by Indigo.

6. Consent
Does the tech company obtain a user’s consent before sharing user data with third parties? (E.g. integrations, government and others)
Yes. By initially accepting the Carbon by Indigo agreements and Indigo’s privacy policy, you agree that Indigo may share your data, including identifiable data to the extent necessary, with third parties to verify your eligibility and compliance with the program, and to generate, verify and issue carbon credits. In addition, your initial consent means that Indigo may create de-identified and aggregated data that may be used for, and included in, research and development initiatives of Indigo, its affiliates or third parties to promote the study or adoption of sustainable and/or environmentally beneficial agriculture practices and programs. Research based on or including data you provide may be made available to third parties or to the public on a de-identified basis and/or after aggregation with a sufficient number of data sources so that any one source cannot be reasonably determined. Except where required by law, Indigo will not share your data with government regulatory agencies unless you provide your consent and direction.

7. Consent
By signing up, does the user give the tech company the right to sell aggregated data to third parties without obtaining further consent?
Yes. Data you provide may be used for, and included in, research and development initiatives of Indigo, its affiliates or third parties to promote the study or adoption of sustainable and/or environmentally beneficial agriculture practices and programs, and that such research, which may include data you provide, may be made available to third parties or to the public on a de-identified basis and/or after aggregation with a sufficient number of data sources so that any one source cannot be reasonably determined.

8. Portability
Does the tech company maintain an original copy of user data that can be retrieved or deleted upon a user’s request?
No, this functionality is not available at this time.
9. Data Security
Will the tech company notify the user if a breach of data security causes disclosure of the user’s data to an outside party?
Yes. In the event of a data breach, natural disaster, or other unforeseen event that causes your data to be deleted or compromised, Indigo will notify you when you log in, by email, or other method, as required by law.

10. Notice
Will the tech company notify the user when data agreements are changed and summarize how the agreements were changed?
Yes. Changes will be communicated to you in writing, along with a summary of the changes, via the e-mail address, mailing address or mobile telephone number you have on file with Indigo.

11. Changes in Company Ownership
Do the tech company’s data agreements address what happens to user data if the tech company is sold to another company?
Yes. In the event Indigo transfers its rights and obligations under your Indigo Carbon agreement, including by sale or acquisition, your Indigo Carbon agreement will continue to apply to data you submit to Indigo until you are provided notice of changes to your Indigo Carbon agreement.
